As the employer you become responsible for paying the Childcare professionals Tax and National Insurance (Maternity Nurses, Night Nannies & Doulas are classified as self-employed) whether it is full time, part time or temporary.  It is illegal to avoid paying this tax.

Employees are entitled to a minimum of 4 weeks paid annual leave and Bank holidays.

If your employee is sick for more than 4 consecutive days, you the employer are obliged to pay Statutory Sick Pay (SSP).  If your employee is sick any additional days it is at the employers discretion as to whether you pay them.

Your employee will be entitled to Statutory Maternity Pay (SMP) if she has been employed with you for a period of 26 weeks continuing into the 15th week before the baby is due.  SMP is paid for up to 26 weeks, starting from the 11th week before the baby's due date.  She will be entitled to 90% of the her average salary for the first 6 weeks and at the stipulated rate by legislation for the remaining weeks which is currently £108.85p/week.

A small employer along with an additional 4.5% can recover SMP in full by deducting the amounts paid from future Tax & NI contributions or by obtaining SMP from the Inland Revenue in advance.

If your Childcare professional has a student loan the government requires you the employer to collect the repayments through PAYE system. These will be deducted from their salary and paid over to the Inland Revenue. 

Current National Minimum Wage - Detailed below for all age groups

  • Employees aged 22 must receive a minimum gross pay of £5.35 per hour
  • Employees aged 18-21 must receive a minimum gross pay of £4.45 per hour
  • Employees aged 16-17 must receive a minimum gross pay of £3.30 per hour
